SES mandate on Standardised European Rules of the Air (SERA) implementing rule for airspace – Part B - COMPLETED

EUROCONTROL has been mandated by the European Commission to develop, in close co-operation with EASA, common and standardised European rules of the air, with a view to supporting implementation of Functional Airspace Blocks (FAB’s), helping free movement of aircraft across Europe’s borders, increasing safety and minimising the inconvenience and risk of misunderstandings caused by varying national sets of rules of the air.

Several successive phases have been identified to develop SERA. A first phase, termed “Part A”, focused on the European transposition of the provisions of ICAO Annex 2. This second phase (“Part B”) focuses on transposition of ICAO Annex 11. It will be followed by the relevant supplement containing the European common differences if applicable.

Following the first phase, the EC has updated the mandate on SERA.

During it’s 45th session the Single Sky Committee voted a positive opinion on the proposed draft regulation on SERA which combined the contents of Parts A and B.


Presently, EUROCONTROL does not provide any generic support to the implementation of SERA.

Final Report

As requested by the amended mandate, the draft implementing rule SERA Part B and the associated outcome of the consultation (final report) have been delivered to the European Commission via EASA, and then published in the form of an EASA Opinion on 14th November 2011. Subsequently, a formal letter was sent by EUROCONTROL to the EC in order to formally close Phase 2 of SERA.


A written informal consultation took place between the 12th November and the 6th December 2010. The proposed informal consultation package was distributed with the intention to collect stakeholders' views and to improve the visibility on the early drafting phase and on the principles applied.

In accordance with the amended SERA mandate requirements, the formal consultation was conducted via the consultation process of the European Aviation Safety Agency (EASA) and not via the ENPRM process which had been used for the formal consultation on the draft SERA IR Part A.  The Notice of Proposed Amendment was held between 10th February and 10th May 2011 and has been published on the EASA website (NPA 2011-02).

A joint EUROCONTROL/EASA stakeholder consultation workshop was held 19th September 2011 in EUROCONTROL to present the results of the formal consultation. The comment response document has been published on the EASA website (CRD 2011-02).


Regulatory Approach

The mandate will benefit from, the work already achieved by EUROCONTROL, ICAO and the EC which have conducted since 2007 a review of the EU national differences. The regulatory approach for the development of the implementing rule is indicated in the mandate as it calls for an implementing rule that ensures an ICAO compliant solution, complemented, if justified or if deemed more efficient, by common European differences, and by additional appropriate non-binding regulatory material.
As a result, a Regulatory Approach Document was not developed for this mandate.


The initial plan describes the project plan and work breakdown structure, the methodology and processes and the consultation activities as agreed with the European Commission. It also provides an initial analysis of the mandate requirements.
This document is the complementary EUROCONTROL initial plan proposal for Phase 2 of the development of a draft implementing rule on Standardised European Rules of the Air.
