On the 15th March 2007, the carriage of 8.33 kHz capable radios became mandatory in the airspace above FL195.

As demand for new frequencies to support aeronautical VHF air-ground voice communications continues to grow, making the task of finding suitable frequencies increasingly difficult, it is now the right time to address the implementation of 8.33 kHz below FL195.
The EUROCONTROL Stakeholder Consultation Group (SCG) at its 10th meeting held 25/26 February 2009 in Brussels, supported a phased implementation of 8.33 kHz below FL195 in the ICAO EUR Region, and agreed that EUROCONTROL develop a European Implementation Plan with the participation of all affected stakeholders
As result EUROCONTROL created the 8.33 Programme Steering Group to prepare an update to the Air-ground Voice Channel Spacing Implementing Rule (A-VCS IR) – Commission Regulation (EC) No 1265/2007 to address the deployment of the 8.33 kHz channel spacing below FL195.
Two potential regulatory options/scenarios have been drawn up:
- Scenario 1 - Development of regulatory provisions identifying three implementation milestones
- Forward Fit Phase starting from 2012 to ensure all new radios comply,
- Interim Phase for 2014 to ensure a given number of conversions take place,
- Final Phase for 2018 to ensure 8.33 kHz spacing of all possible voice channels.
- Scenario 2 - Development of regulatory provisions identifying two implementation milestones
- Forward Fit Phase starting from 2012 to ensure all new radios comply,
- Final Phase for 2018 to ensure 8.33 kHz spacing of all possible voice channels.

One of the two Scenarios will be selected in June 2010 to develop a full draft proposal for an update of the A-VCS IR and an impact assessment comprising Safety and Business Cases. This proposal will be subject to a a full formal consultation prior to the update of the Implementing Rule. This formal consultation is expected to take place in November/December 2010.
