ACAS Policy

The ECAC Member States have commonly agreed on an ACAS policy and a mandatory ACAS II implementation schedule. This mandatory implementation does not apply to State Aircraft.

Military Transport Type Aircraft

However, the Military Authorities of the ECAC Member States agreed on a voluntary installation programme on military transport-type aircraft (MTTA) equivalent to their Phase 1 civilian counterparts by 1 January 2005 (See Note on Phase 1).

Situation in German airspace

Notwithstanding that the military commitment is voluntary, Germany has made ACAS II mandatory within its airspace, from 1 January 2000, for all aircraft whether civil or MTTA, which meet the Phase 1 criteria, and from 1 January 2005 for all aircraft whether civil or MTTA which meet the Phase 2 criteria (See Note on Phase 2).

As from 01 January 2005 German authorities put in place transitional arrangements and an exemption process:
  • The provisions of the transitional arrangements allow for temporary exemptions to be granted to military transport type aircraft if the State Aircraft Operators are unable to comply with the ACAS II mandate.
  • For confidentiality reasons, State Aircraft Operators will not be required to request exemptions for each of their aircraft based on their individual registration. Instead, the State Aircraft Operator shall request exemptions for their particular aircraft fleet, including types and numbers of aircraft, which are subject to the ACAS II mandate.
  • The exemption requests have to be supported by fleet based equipage (or installation) plans that shall provide the proof of intent to achieve the compliance to the mandatory carriage and operation of ACAS II requirements as soon as possible. The ACAS II State Aircraft Operator Exemption Request Form that should be used for the exemption request is attached below together with the relevant German AIC.
  • Each exemption request will be considered on an individual basis. Applications will be progressed expeditiously, however, State Aircraft Operators seeking ACAS II exemptions are encouraged to submit their applications (including the necessary information and documentation) as early as possible, but in any case not later than 31 MAR 2005.

Notes on Phase 1 & 2:
  • Phase 1 - Fixed-wing turbine engined aircraft having a maximum certificated take-off mass exceeding 15,000kgs, or a maximum approved passenger seating configuration of more than 30, were required to be equipped with ACAS II.
  • Phase 2 - Fixed-wing turbine engined aircraft having a maximum certificated take-off mass exceeding 5,700kgs, or a maximum approved passenger seating configuration of more than 19, were required to be equipped with ACAS II.
