Important Information for aircraft operators with 2010 traffic and who are not yet allocated to an EU ETS Administering Member State

The following information applies to aircraft operators who expect to:

• have at least 1 flight covered by the ETS Directive in 2010 once all the exemption criteria (a) to (j) of Annex I to the Directive have been applied (i.e. any non-exempt EU 27 flight in 2010), and

• Have not yet been formally allocated to an Administering Member State by means of publication on the EU ETS Operator list

Such operators are kindly invited to submit an EU ETS Fleet List as soon as possible and at the latest by March 15th 2010

The completed form should be submitted directly to the European Commission at:

ENV-EU-ETS-AIRCRAFT-OPERATOR-LIST@ec.europa.eu

Aircraft Operators submitting Fleet Lists and who are confirmed as having previous traffic which is covered by the ETS in the period 01 January 2006 to 31 December 2010 will subsequently be published in a special edition of the EU ETS Prior Compliance List on the 23rd March 2011.

The edition of the Prior Compliance List published on 23rd March will allocate eligible aircraft operators to an Administering Member State and will thus allow those aircraft operators to contact the appropriate Competent Authority in order to make arrangements for meeting their ETS obligations by the 31st March 2011 reporting deadline

Please note that publication on 23rd March Prior Compliance List does not mean that ETS Competent Authorities have an obligation to accept an aircraft operator's 2010 emissions reports. However, it does allow the aircraft operator in question to make contact with the Competent Authority to discuss the best way to proceed

Please make sure that all relevant fields are completed as if we need to contact you for any clarifications you may miss the deadline for the Prior Compliance List (15th March 2011).

Operators who have already submitted a Fleet List but are not yet allocated to an Administering Member State

If you have already submitted a Fleet list and have not yet been allocated to an Administering Member State, this may be because:

1) Your Fleet list was submitted after the cut-off date for the last update of the ETS Operator List and will be included in the next update.

2) Information was missing from your Fleet List and so it could not be processed.

3) Your Fleet list included a declaration covering an aircraft registration which had already be attributed to another aircraft operator during the same time period.

4) Your Fleet List was submitted to the wrong contact address
