CONDITIONS AND TERMS OF PAYMENT |
|
In addition to the general terms of use of the EUROCONTROL website the following conditions and terms of payment apply to the electronic provision of data to the aircraft operator (the “applicant”) to facilitate its compliance with the Union’s Emission Trading Scheme (the “ETS”) requirements as enacted by Directive 2003/87/EC.

General terms of use of the EUROCONTROL website |

These conditions and terms of payment are at all times available on the EUROCONTROL environmental website and the ETS support facility for aircraft operators (the “system”). The system allows the applicant, upon completion of the registration and payment formalities, to receive its flight details for 2011, as well as a draft report of estimated CO2 emissions resulting from those flights (the “ETS data”).

I. Application
When the applicant sets up an account for access to the ETS data, EUROCONTROL is entitled to send it emails acknowledging the receipt, eligibility and acceptance of its registration into the system.
II. Eligibility check
Pre-verification of identity is necessary for security reasons. To this end, EUROCONTROL may communicate the registration information submitted by the applicant to the competent national authority and to the operator regulated by the ETS if legally different than the applicant.
EUROCONTROL reserves the right to cancel an application at any time after its submission if the registration information provided, namely the contact, administrative details, and email address(es) of the applicant, are insufficient to enable EUROCONTROL to accept the application.
III. Payment
Upon acceptance of the application, EUROCONTROL will charge, through a company supplying a payment service, the applicant for the marginal flat-rate cost of providing it with the ETS data as follows:
- 2011 draft emissions report and associated flight data ……………………….400 EUR
The provision of the ETS data shall be subject to the prior full payment of the above charge.
IV. Disclaimer
The compliance of aircraft operators and their intermediaries (service companies, verifiers, etc.), with their obligations under Union law, the ETS and national law remains entirely their own responsibility. EUROCONTROL does not guarantee a particular outcome of a validation procedure by the competent national authority on the compliance of the ETS data provided to the aircraft operator and/or its intermediaries nor does EUROCONTROL assume any liability for claims or damages sustained as a result of the use of the ETS data. These data, in most cases, will need to be verified by official accredited bodies prior to their submission to the national competent authority.
