What is the The ETS-SF/AO

The ETS-SF/AO is a support function operated by EUROCONTROL to provide Aircraft Operators (and other third parties authorised by them such as verifiers and service companies) included in the European Commission’s EU ETS list of Aircraft operators with information to support them in discharging the obligations pursuant to Commission Decision No 2007/589/EC of 18 July 2007 establishing guidelines for the monitoring and reporting of greenhouse gas emissions pursuant to Directive 2003/87/EC of the European Parliament and of the Council (Official Journal of the European Union, series L, number 229, 31 August 2007), last amended by Commission Decision 2009/339/EC of 16 April 2009.

The ETS-SF/AO support function has been approved by EUROCONTROL’s Permanent Commission through Directive 11-75 (4 February 2011).
  
 

What will be provided?

The information provided by EUROCONTROL for a specific Aircraft Operator consists of:

- a draft annual emissions report for 2011, presenting what that Aircraft Operator’s report would be if based on the flight data information available to EUROCONTROL and on the fuel burn and CO2 emissions estimated by EUROCONTROL by applying the same methodology used in the EUROCONTROL small emitters tool. This draft report is provided in the form of an Excel file compliant with the EU ETS Scheme reporting format for such documents. This report will include also the "kilometres" data for the airport pairs contained in the report (for the tonne-kilometre verification);

- a text file in a comma separated file (csv) format containing the list of the flights attributed to the Aircraft Operator and operating in the ETS area (both included and exempted fights) with details allowing the identification of the flight and the reasons for its inclusion, exemption, the attribution to the operator, and the "kilometre" data (departure airport , destination airport , departure date and time , call sign , aircraft registration mark -if available-, flown distance , applicable route charge exemption -if any- , estimated fuel consumption , estimated CO2 emissions, possible ETS exemption as determined by EUROCONTROL) upon which the Aircraft Operator’s draft annual emissions report is built.

Who can request support?

An Aircraft Operator’s draft annual emissions report and associated flight data generated by EUROCONTROL may be of interest and support to Aircraft Operators (both small emitters or larger operators), verifiers mandated to verify an Aircraft Operator’s annual emissions or tonne-kilometre report and service companies acting on behalf of Aircraft operators.
  
 

What identity checks will be made?

An Aircraft Operator’s draft annual emissions report and associated flight data have a confidential nature which implies that they can only be provided to the Aircraft Operator or an entity or person duly authorised by the Aircraft Operator itself.

Whereas a request can be submitted by any entity or person, EUROCONTROL will perform a check of the request received to ensure that the entities or persons to which the information is to be provided are entitled to receive such information.

For performing this check, EUROCONTROL will co-operate with the ETS Competent Authorities of the EU Member States in order that this check can be performed on the basis of information provided in the Aircraft Operator’s monitoring plan submitted to the relevant Competent Authority.

Therefore, access to the support function concerning the information and data related to an Aircraft Operator requires that an Aircraft Operator has submitted an ETS Monitoring Plan to its relevant Competent Authority.

The check will ensure that the entities or persons to which the information is to be provided according to the request is the Aircraft Operator as identified in the ETS Monitoring Plan available to the relevant Competent Authority.
If, according to the request, the information is to be provided to one or more entities or persons other than the Aircraft Operator, the Aircraft Operator as identified in the ETS Monitoring Plan will be contacted to confirm the request.

  
 

What can the data be used for?

Small Emitters

According to section 4 of Annex XIV of the MRG, “aircraft operators that are small emitters may estimate the fuel consumption using tools implemented by Eurocontrol or another relevant organisation, which can process all relevant air traffic information such as that available to Eurocontrol. The applicable tools shall be used only if they are approved by the Commission including the application of correction factors to compensate for any inaccuracies in the modelling methods”.

The Commission has approved in July 2010 a fuel estimation model (and associated tool) developed by EUROCONTROL which thus can be used for the computation of the fuel consumption and associated CO2 emissions to be included in the annual emissions report.

An Aircraft Operator which is a small emitter in 2011 may thus request the ETS-SF/AO information and rely on the provided draft annual emissions report generated from the best available data and flight information available to EUROCONTROL, to produce its official annual emissions reporting.

The (small emitter) Aircraft Operator may use this information as such or modify as it deems appropriate to produce its official annual emissions report. In all cases, the Aircraft Operator remains liable for the completeness and accuracy of the annual emissions report it submits for verification and, finally, to the relevant Competent Authority.


Aircraft Operators

An Aircraft Operator (other than a small emitter) may be interested to obtain the ETS-SF/AO information in order to perform internal quality checking of its own information.

Verifiers

A verifier may request an Aircraft Operator to receive the EUROCONTROL information and data in order to verify the Aircraft Operator’s report generated by either the Aircraft Operator’s own data or by relying on the information provided via the ETS-SF/AO function by EUROCONTROL (this could be the case of a small emitter).

In order to allow a verifier to obtain EUROCONTROL’s data directly, the request for obtaining ETS-SF/AO information allows requesters to specify up to three delivery addresses.

Service Companies

An Aircraft Operator may be relying on service companies for supporting it in discharging its obligations under the EU ETS. For instance, the service company may be preparing the Aircraft Operator annual emissions report, gathering and processing all required information,

An Aircraft Operator may request the ETS-SF/AO information to be delivered to such a service company.

Once again, the request for obtaining ETS-SF/AO information allows requesters to specify up to three delivery addresses.
  
 

How is payment made?

A fee of 400 Euros is requested per access granted for an Aircraft Operator’s information and data and delivery of the Aircraft Operator’s 2010 draft annual emissions report and associated flight data. The payment shall be made on-line by credit card and before the effective delivery of the information.

Note: EUROCONTROL is an international organisation with no economic activities. EUROCONTROL is not tax liable in the sense of Article 4 of the 6th VAT Directive 77/388/CEE and has no VAT registration number.
Consequently, EUROCONTROL services are free of VAT

EUROCONTROL’s general mandate relates to work in the Air Traffic Management field. Any work relating to another area requires a prior request and authorisation by EUROCONTROL Stakeholders who then also agree on the financial conditions associated to the specific work. This support function was authorised on the basis that its full costs should be recovered from its users.

These full costs concern mainly:
- the development of the internet and informatics solution to manage requests and payment according to security and confidentiality requirements,
- the automated generation of the files delivered (see what)
- the manning and operation of an ETS office to perform all tasks that cannot be automated and supervise the overall function.

It is to be noted that the maintenance and processing of all Flight Data information into an ETS Support Facility Data Base where information is directly exploitable at a flight, Operator or National level for ETS purpose is an activity performed by EUROCONTROL as part of an ETS support activity developed for EU ETS Competent Authorities and paid for by them. This activity is therefore not included in the costs associated with the ETS support function for Aircraft Operators and related third party users.

The amount of 400 Euros is an amount based on an estimation made by EUROCONTROL of the costs to develop and operate the ETS-SF/AO function and on an assumption of the number of users which will subscribe to this function. As the work specifically performed for the support function is not dependent on the amount of traffic of the Aircraft Operator (see previous paragraph), the same nominal fee is to be paid per Aircraft Operator independently of its nature, traffic volume, emissions amount and information delivery addresses.

EUROCONTROL being a non profit Organisation, the balance between the actual costs of the development / operation of the support function and the sum of the payments by the users will be computed at the end of the support period. If the balance is beneficial, the overpaid amount will be reinvested as “free costs” in the further development / operation of the support function for the next year. If the balance is in deficit, the continuation of the function will necessarily be re-assessed.

EUROCONTROL is in contact with Aircraft Operators and Aircraft Operators’ associations through some of its governing bodies or working groups. EUROCONTROL will communicate the performance and financial results of the support function in relevant bodies or groups, as well as discussing continuation possibilities for the function.
  
 

What are the terms and conditions of payment?

The access to and delivery of the information and data is subject to the requester’s approval of some general terms and conditions.
