The EUROCONTROL Notice of Proposed Rule Making (ENPRM) Regulatory process is the mechanism by which EUROCONTROL develops rules requiring widespread consultation of stakeholders. All interested parties (including the public) may comment on draft rules issued by EUROCONTROL before they become binding on EUROCONTROL Contracting Parties.
The ENPRM Regulatory process was approved by the EUROCONTROL Permanent Commission on 12 July 2001 (subject to a reservation by one State). Its underlying principles have been in successful use by major regulatory bodies such as the FAA and JAA for many years and provide a well-tried model for rule making.
The ENPRM regulatory process was written to ensure traceability to and compatibility with related
ICAO provisions. Provisions concerning implementation dates, including exemptions policy, are kept separate from the main technical provisions in order to ensure best possible harmonisation between EUROCONTROL and European Community regulatory provisions. The European Commission clearly expressed its support for the use of the ENPRM Regulatory process to develop regulatory material and encourages the use of the same mechanisms for the development of advisory material.
Certain mechanisms of the ENPRM Regulatory process are used to support the development of draft implementing rules arising from Single European Sky (SES) mandates given to EUROCONTROL. These include, notably, the Drafting, Consultation and Review of Comments Phases and regulatory impact assessment procedures.
