Formal Consultation comments closed on 8 April 2011

EC Regulation 1265/2007 laying down requirements on Air-ground Voice Channel Spacing for the Single European Sky has been successfully implemented through the deployment of 8.33 kHz communications in the airspace above Flight Level 195. As mentioned in its preamble, this Regulation was considered only as a first step, to be expanded in due time by a second phase, to address the entire airspace and in order to respond to the further demand for additional VHF requirements.

In accordance with the original mandate and the subsequent developments, regulatory material has been prepared, extending the application of 8.33 kHz communications to the airspace below Flight Level 195. This Draft Implementing Rule has been developed in close consultation with Stakeholders, based on a Regulatory Approach and taking into account Stakeholder input on all aspects of the Air-Ground Voice Channel Spacing requirements.

The Draft Implementing Rule on Air-Ground Voice Channel Spacing extending the deployment of 8.33 kHz in the airspace below Flight Level 195 is therefore now being submitted for formal consultation, using the mechanisms of the EUROCONTROL Notice of Proposed Rule-Making (ENPRM) process. The formal consultation allows all States, Stakeholders and interested parties to express their formal views on the Draft Implementing Rules and I would, therefore, strongly encourage you to respond within the timescales described below.
The subject of this formal consultation is therefore the draft SES Implementing Rule s for Air-ground Voice Channel Spacing. The comments period is effective from 2 February 2011 to 8 April 2011. Considering the short timescales imposed on this development, it is not possible to take into consideration responses received after that date. A further workshop, presenting the outcome of the formal consultation will then be organised.

Responses will be compiled, reviewed and taken into account for the preparation of the Final Report, which will include notably reveised Draft Implementing Rules as well as an Impact Assessment and a summary of the outcome of the consultation. EUROCONTROL expects to submit the Final Report on the mandate development to the European Commission by the end of June 2011.

The documentation is available to all interested parties and comments are welcome on its detailed provisions. Instructions for the provision of comments are included in the Consultation Response Sheet (Enclosure 3 of the documentation).
