Formal Consultation comments closed on 5 May 2010 |
In support of the implementation of the Single European Sky regulations, the European Commission has sent to EUROCONTROL a mandate for the development of a draft implementing rule for interoperability on Surveillance performance and interoperability requirements (SPI).
The response to the request on SPI has been developed in close consultation with stakeholders, based on a regulatory approach and taking into account stakeholder input on all aspects of the SPI requirements. A draft implementing rule on SPI was developed and submitted to a formal consultation between 4 November 2008 and 08 April 2009. Following the results of the consultation as well as the request of the European Commission expressed on 6 July 2010, it was decided to enlarge the scope of the regulatory approach so as to address the issue of the use of aircraft identification (ACID).
In response to this decision and in parallel with the update of SPI taking into account the results of the formal consultation, a draft implementing rule on ACID has been developed. Following the written informal consultation that took place between 1 and 23 October 2009 on a proposed interoperability analysis, the relevant stakeholder inputs have been taken into account on all aspects of the ACID provisions, and the draft implementing rule has been subsequently developed. Moreover, due to the extensive modifications brought to the SPI draft it was considered necessary to submit it to a further formal consultation, together with the one on ACID.
The subject of this formal consultation is therefore the draft SES implementing rules on Surveillance Performance and Interoperability Requirements and on Aircraft Identity, the comments period for which is effective from 1 April 2010 to 5 May 2010 inclusive. Considering the short timescales imposed on this development, it is not possible to take into consideration responses received after that date.
A further workshop, presenting the outcome of the formal consultation will then be organised.
Responses will be compiled, reviewed and taken into account for the preparation of the Final Report, which will include notably revised draft implementing rules as well as an impact assessment and a summary of the outcome of the consultation. EUROCONTROL expects to submit the Final Report on the mandate development to the European Commission by the end of June 2010.
The documentation is available to all interested parties and comments are welcome on its detailed provisions. Instructions for the provision of comments are included in the Consultation Response Sheets (Enclosures 5 and 6 of the documentation).
