In support of the implementation of the Single European Sky regulations, the European Commission has sent to EUROCONTROL a mandate for the development of a draft implementing rule for interoperability on Surveillance performance and interoperability requirements (SPI).
In accordance with the Initial Plan for the SPI mandate, agreed by the Commission and the EUROCONTROL Agency, the first step of the development of the draft implementing rule on SPI was the production of the Regulatory Approach. This document was developed in close consultation with stakeholders, culminating in a workshop on 5 July 2007. The final version of the Regulatory Approach document was sent to the European Commission on 17 September 2007.
On the basis of this approach, EUROCONTROL has developed the components of the draft Final Report which includes the draft implementing rule and the justification material.
It is acknowledged that the set of regulatory provisions of this draft implementing rule must be complemented by Community Specifications in order to ensure full interoperability.
The subject of this formal consultation was therefore the draft SES implementing rule on Surveillance Performance and Interoperability Requirements, the comments period for which was effective from 4 November 2008 to 8 April 2009 inclusive. A further workshop, presenting the outcome of the formal consultation will then be organised.
Responses will be compiled, reviewed and taken into account for the preparation of the Final Report, which will include notably a revised draft implementing rule as well as an impact assessment and a summary of the outcome of the consultation. EUROCONTROL expects to submit the Final Report on the mandate development to the European Commission by the end of June 2009.
