Safety Regulatory Requirements |
Since the introduction of the Flexible Use of Airspace (FUA) Concept in March 1996, safety processes have matured and all Air Traffic Management (ATM) enhancements must now comply with European Air Traffic Management (EATM) safety policy requirements and EUROCONTROL Safety Regulatory Requirements (ESARRs).
Two main safety regulatory requirements apply to FUA and refer to the use of :
- safety management systems by Air Navigation Services Providers (ESARR 3) and of
- risk assessment and mitigation, including hazard identification, in Air Traffic Management (ATM) when introducing and/or planning changes to the ATM System (ESARR 4).

In addition, according to the Flexible Use of Airspace (FUA) Regulation, EU Member States shall, in order to maintain or enhance existing safety levels, ensure that, within the context of a safety management process, a safety assessment, including hazard identification, risk assessment and mitigation, is conducted, prior to introducing any changes to flexible use of airspace operation.

Enhanced Flexible Use of Airspace (FUA) Process Safety Documentation |
The Safety Documentation (see Diagram below) developed by EUROCONTROL for the Enhanced FUA Process consists of:
- The “Enhanced FUA Process Safety Policy” document which defines the safety policy statements and high level safety objectives for the Enhanced FUA Processes within ECAC States and lists applicable safety criteria;
- The “Enhanced FUA Process Safety Plan” document which describes the safety assessment activities which need to be performed, by EUROCONTROL and the implementing States, to demonstrate that the implementation of Enhanced FUA Processes is acceptably safe;

As each Operational Improvement has a distinct character and implementation timeframe, their requirements for safety assessment are likely to vary in detail. To address such potential differences, the “Enhanced FUA Process Safety Plan” provides for each OI in a specific Appendix more details on the safety assessment activities required.
Up to now, only one “Outline Safety Case” has been developed by EUROCONTROL for Enhanced Real-time Civil/Military Coordination.
As far as National Collaborative/Integrated Airspace Planning is concerned, there is no need to establish a generic Outline Safety Case, as it entails only a change in procedures used by each State at the Strategic ASM Level 1. Each State is therefore required to develop a national safety case to ensure that National Collaborative Airspace Planning is acceptably safe to implement within its own State boundaries.
Likewise each State wishing to implement Extend FUA Application to the Lower Airspace, whenever the use of FUA principles would be beneficial and feasible, will have to develop its own national safety case.
As regard to Enhance FUA with Dynamic Airspace Management, it is intended to develop in a similar way as for Enhanced Real-time Civil/Military Coordination an Outline Safety Case to provide argument and evidence as to why EUROCONTROL believes that its Enhanced FUA Process with Dynamic Airspace Management is acceptably safe for implementation in its Member States.
