Regulatory Framework

Institutional Framework

The Flexible Use of Airspace (FUA) Concept recommended by the International Civil Aviation Organisation (ICAO)* and developed by EUROCONTROL has been endorsed by the European Civil Aviation Conference (ECAC) Ministers of Transport in June 1994 with the intention of increasing airspace capacity and improving the efficiency and flexibility of aircraft operations.

Under provisions of the EUROCONTROL Revised Convention, the Organisation shall undertake the task to develop, adopt and keep under review common standards, specifications and practices for air traffic management systems and services. To that end, a EUROCONTROL Regulatory and Advisory Framework (ERAF) is under development to establish mandatory and non-mandatory regulatory material for Air Traffic Management (ATM) systems and services with a clear status and applicability for Contracting Parties consistent with existing State obligations to International Civil Aviation Organisation (ICAO) and/or European Community (EC) Regulations.

Single European Sky (SES) Regulatory Framework

The legislative package adopted by the European Parliament and the Council of the European Union with the objective of achieving a Single European Sky (SES)** comprises four regulations covering the essential elements for a seamless European Air Traffic Management System:
  • Regulation (EC) No 549/2004 of the European Parliament and of the Council of 10 March 2004 laying down the framework for the creation of the Single European Sky (the framework Regulation);

  • Regulation (EC) No 550/2004 of the European Parliament and of the Council of 10 March 2004 on the provision of air navigation services in the Single European Sky (the service provision Regulation);

  • Regulation (EC) No 551/2004 of the European Parliament and of the Council of 10 March 2004 on the organisation and use of the airspace in the Single European Sky (the airspace Regulation);

  • Regulation (EC) No 552/2004 of the European Parliament and of the Council of 10 March 2004 on the interoperability of the European Air Traffic Management network (the interoperability Regulation).

These four regulations will be complemented by more detailed implementing rules to be adopted by the European Commission after discussion within the Single Sky Committee. A specific Commission Regulation laying down common rules for the flexible use of airspace (the flexible use of airspace Regulation) is about to be adopted to ensure the uniform application within the single European sky of the Flexible Use of Airspace Concept.

Policy Decisions, Practices, Specifications and Planning Guidelines

To ensure consistency between the different regulatory materials applicable, European Civil Aviation Conference (ECAC) airspace will be governed in the context of the new Single European Sky (SES) Regulatory Framework with the following elements:
  • Policy Decisions: political commitment to apply the Flexible Use of Airspace Concept (i.e. FUA Regulation (EC), FUA Report endorsed by the ECAC Ministers of Transport);

  • Recommended Practices: additional Airspace Management (ASM) functions and Air Traffic Management (ATM) procedures for air navigation services not covered by existing ICAO PANS-ATM or PANS-OPS so as to make best use of European airspace for civil and military purposes and of ATM resources (i.e. EUROCONTROL Handbook for Airspace Management);

  • Specifications: common system-support functions required for efficient airspace management and civil/military coordination (i.e. EUROCONTROL Functional Specifications for System Support to Airspace Data Distribution and Civil/Military Co-ordination);

  • Guidelines: detailed planning elements and methods of application for a common airspace design and change process in the ECAC area (i.e. EUROCONTROL Manual for Airspace Planning).
